1.Validity of the general conditions of sale

1.1. General Terms and Conditions of Sale apply to the customers of VENTILAATORID24.ee (hereinafter referred to as the Customer) and the owner of VENTILAATORID24.ee Ventilaatorid24 OÜ (reg. number 16151119, reg. Artelli 7, boks 2 (Ventilaatorid 24)) on the legal relations between the Customer and the Client for the purchase of goods.

1.2 The General Terms and Conditions of Sale cannot be in conflict with the laws and regulations in force in the Republic of Estonia and, if necessary (in the event of disputes or lack of information), they have been supplemented with these norms.

In addition to these General Terms and Conditions of Sale, the relations between the Customer and VENTILAATORID24.ee are governed by VENTILAATORID24.ee product information, price list, purchase information and established good practices.

1.4. VENTILAATORID24.ee reserves the right to unilaterally change these terms and conditions and the prices of the products for the purpose of efficiency, competitiveness, future development and supplementation or reorganization of the range of goods. The modifications and amendments to the terms and conditions and to the prices of the products shall take effect from the moment of publication of the said information on the site www.VENTILAATORID24.ee. In the event that the Customer submits an order prior to the entry into force of the amendments to the Terms and Conditions, the Customer shall be subject to the terms and conditions in force at the time of the submission of the order, unless otherwise provided by law or these Terms and Conditions.

1.5 VENTILAATORID24.ee and the Customer wish to trade via the VENTILAATORID24.ee website www.VENTILAATORID24.ee under the conditions set out herein. By placing an order on the website of VENTILAATORID24.ee and by making a prepayment, the Client confirms that he has read and agrees to the terms and conditions of sale.

1.6 The images accompanying the Products are for illustrative purposes only.

1.7 Ventilaatorid24 OÜ is the controller of the personal data, Ventilaatorid24 OÜ transfers the personal data necessary for the execution of payments to the processor Montonio AS.

 

2. VENTILAATORID24.ee Price list

2.1. The prices of the products sold in the VENTILAATORID24.ee e-shop are given in euros and do not include delivery costs.

2.2 The price of delivery of goods depends on the delivery method chosen by the Customer when placing the order.

2.3. VENTILAATORID24.ee reserves the right to adjust prices. If the Customer has submitted his order before the price change comes into effect, the price that was shown on the advance invoice at the time the order was placed will apply.

 

3.Shopping cart and placing an order

3.1 The Customer’s Shopping Cart is created at the moment the Customer clicks on the “Add to Cart” button.

3.2 Adding a Product to the Shopping Cart does not commit the Customer to purchase the Product.

3.3 The Customer can modify the quantity of Products in the Shopping Basket and can remove Products from the Shopping Basket if they wish.

3.4. The products in the shopping basket are available to other VENTILAATORID24.ee Customers until the order is confirmed.

3.5. To place an order, the Customer clicks on the “Prepare purchase” button.

3.6. When placing the order, the Customer selects the delivery method and payment method that suits him/her and checks the correctness of the data of the Recipient and the Payer.

3.7 The accuracy of the information provided in the Order is dependent on the smooth delivery of the Products purchased by the Customer. After clicking on the “Place Order” button, an invoice for the prepayment will be automatically sent to the Customer’s e-mail address.

3.8. The sales contract shall be deemed to be concluded if the Customer has paid within 2 calendar days at least 50% of the amount due on the basis of the prepayment invoice to the current account of VENTILAATORID24.ee.
The order shall be posted when 100% of the amount due on the basis of the prepayment invoice has been received on the account of VENTILAATORID24.ee.

 

4.Payment for ordered goods

4.1. On the basis of a prepayment invoice by bank transfer. To pay by bank transfer, click on the bank transfer icon (Swedbank, SEB, Luminor, LHV, Coop Bank, Pocopay).

4.2. Once the Customer has confirmed the order, an invoice for payment in advance will be immediately sent to the e-mail address provided by the Customer.

4.3. If the Customer has not received an order confirmation to his e-mail address within 1 hour after placing the order, please contact info@VENTILAATORID24.ee.

4.4 The invoice for the advance payment will indicate the products ordered by the Customer and the contact details to which the order will be sent. The prepayment invoice will also include the details of VENTILAATORID24.ee and the bank account to which payment can be made.

4.5. If the Customer has not paid the prepayment invoice within 3 calendar days from the date of issue of the prepayment invoice, VENTILAATORID24.ee will consider this as the Customer’s wish to withdraw from the purchase and cancel the order.

 

5.Delivery and handover of products

5.1 After entry into force of the Agreement in accordance with clause 3.8. of the Terms and Conditions and provided that clause 1.5. has been complied with, the Products shall be delivered to the address provided by the Customer in the order.

5.2 The Customer may choose between the following delivery methods:

5.2.1 Itella Smartpost, Omniva post office (Estonian Post), Omniva courier (ELS courier) and international delivery.

5.3. VENTILAATORID24.ee reserves the right to change the delivery methods.

5.4. The accuracy and correctness of the information provided in the order is dependent on the avoidance of delays and misunderstandings in the delivery of goods. VENTILAATORID24.ee and Itella Smartpost, Omniva shall not be liable for delays in the delivery of products and for misunderstandings that arise if the delay or misunderstanding is due to the inaccuracy or incorrectness of the information provided by the Customer when placing the order.

5.5 In the event of a change of destination, VENTILAATORID24.ee will ask the Customer to provide the new details as soon as possible. If the goods have already been dispatched, it is no longer possible to change the destination.

5.6. If the shipment has been posted by VENTILAATORID24.ee, a notification will be sent to the Customer’s e-mail address.

 

6.Delivery deadlines

6.1 Delivery time – “In stock” means that the goods are in stock and will reach the customer within 3-4 days unless otherwise agreed. Goods in stock will be delivered to the parcel terminal within three days.
6.2 Delivery time – “2 weeks” means that the goods are in Estonia and will reach the customer within 2 weeks unless otherwise agreed.
6.3 Delivery time – “3-4 weeks” means that the goods are not in Estonia as they are not warehouse goods and will arrive in Estonia and reach the customer within 2 weeks unless otherwise agreed. Occasionally, for reasons beyond our control, the goods may not arrive within two weeks, but may be a few days over the delivery time.
6.4 Delivery time – “5-8 weeks” is for products manufactured to order, the time for which is booked in accordance with the order of work, normally within five weeks by agreement, but may be extended during the season.

 

7.Cancellation of the order

7.1.VENTILAATORID24.ee has the right to cancel the Client’s order if the invoice is not paid within 3 calendar days or within the payment term requested by the Client.

7.2 The Customer has the right to cancel the order after the advance payment for the ordered products but before the delivery of the products, by notifying VENTILAATORID24.ee by e-mail to info@ventilaatorid24.ee in a statement to that effect. In the statement, please also indicate your invoice/receipt number. The remaining amount paid in advance for the cancelled order will be returned to the Customer’s bank account within 3 working days, but never later than 14 working days after the submission of the request.

 

8.Return of goods

The conditions, procedures and definitions set out below in relation to the withdrawal from the sales contract apply only to consumers who comply with the consumer protection laws in force in the Republic of Estonia.

8.1 Many of our products are covered by a money-back guarantee. If you decide to return an item without a reason, you have 14 calendar days to do so.

The product can be returned within 30 days if you notify us in writing within 14 days. In this case, the product is subject to a number of additional conditions. The product must be undamaged in its packaging, must be accompanied by all authentic labels and protective wrappings, and must look exactly as it did when you bought it. If you have damaged the packaging, you will not be able to return the good quality goods or get a refund after 14 days.

The 14-day return policy does not apply to legal persons.
The 14 day return policy does not apply to products ordered with a delivery time of more than 14 calendar days.

8.2 To return the goods, the Customer shall fill in the return form https://ventilaatorid24.ee/avaldus-25-06-2021.pdf. and forwards it to info@ventilaatorid24.ee. The money will be returned by bank transfer to the bank account within 3 working days from the date of the transaction, unless otherwise agreed between the Seller and the Client.

8.3 The costs of returning the goods shall be borne by the Buyer.

8.4 If the Customer wishes to exchange the returned product for another product or another size of the same product, the Customer shall pay the postage for the returned product. For the postage of the new exchanged product, VENTILAATORID24.ee shall pay a one-time postage fee. For each subsequent exchange, the Buyer shall pay.

VENTILAATORID24.ee shall bear the cost of returning the goods if the goods are damaged, which could not be detected by external inspection and not caused by opening the package or if the goods are not what was ordered.

8.6 All disputes arising in connection with the implementation of the provisions of the general terms and conditions of the order, the parties shall try to resolve by negotiation. In the event that the parties fail to reach an agreement, the disputes arising shall be settled in accordance with the laws of the Republic of Estonia. In order to settle disputes, the consumer-customer has the right to refer to the Consumer Disputes Committee, the information on which can be found HERE, or to the European Union Consumer Dispute Resolution Platform, which can be found HERE.

 

9.Liability and force majeure

9.1.VENTILAATORID24.ee shall be liable to the Customer for any damage caused by VENTILAATORID24.ee by breach of these Terms and Conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

9.2 The Customer shall be liable to VENTILAATORID24.ee for any damage caused by the Customer by breach of these Terms and Conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

9.3 Neither party shall be liable to the other party, and its conduct shall not be considered a breach of these Terms and Conditions by reason of delay in the performance of any of its obligations or failure to perform any of its obligations, if the cause of such delay or failure to perform was beyond the control of that party (force majeure).

9.4. VENTILAATORID24.ee shall not compensate for any moral damage that may be caused to the customer by changes in delivery times, prices and other terms and conditions under these Terms.

9.5. VENTILAATORID24.ee does not compensate the Client for costs arising from the fact that the Client assumed obligations to third parties (not dependent on VENTILAATORID24.ee) on terms and conditions contrary to these Terms.

9.6. VENTILAATORID24.ee does not compensate the Client for missed opportunities as a result of changes in delivery times, prices and other conditions.

 

10.Other terms and conditions

10.1 VENTILAATORID24.ee will use the personal data provided by the Client only to fulfill the purchase order of the Client. The data will be treated confidentially and will not be disclosed to third parties, except if the method of delivery chosen by the Customer requires it and in cases prescribed by law.

10.2 VENTILAATORID24.ee reserves the right to send the Customer information about new products and promotional offers if the Customer has subscribed to the VENTILAATORID24.ee newsletter. The Customer has the right to request the deletion of his data from the VENTILAATORID24.ee database.

10.3. In matters not regulated by these Terms and Conditions, the Customer and VENTILAATORID24.ee shall be governed by the legislation in force in the Republic of Estonia and other acts regulating the relations between the parties.

10.4. disagreements and disputes arising from the performance of these Terms and Conditions shall be resolved by the parties primarily through negotiations. If disputes arising from the Contract cannot be resolved by negotiations between the parties, both the Client and VENTILAATORID24.ee shall have the right to apply to the Consumer Protection Board or to the court to protect their rights. In addition, the ODR (Online Dispute Resolution) platform of the European Union is open to all Customers for the resolution of complaints with e-retailers at http://ec.europa.eu/odr.

 

11.Final provisions

11.1 Estonian law shall apply to these Terms and Conditions and to the purchase and sales contracts of the e-shop VENTILAATORID24.ee. If any provision of the Terms and Conditions is invalid, this shall not affect the validity of the remaining provisions of the Terms and Conditions or the purchase and sale agreement. The invalid provision shall be replaced by a lawful provision which is legally and economically closest to the invalid provision.

The right of withdrawal does not apply, pursuant to Section 53(4) of the Law of Obligations Act, to the following services and products:
a product which has been handed over to the consumer in a sealed package and which is not suitable for return for health or hygiene reasons, if it is opened after delivery;
a product which, by its nature, is mixed or combined with another thing after delivery in such a way that they can no longer be separated;
audio and video recordings or computer software in a sealed envelope, if the consumer has opened the envelope;
other goods and services provided for in section 53(4) of the LOA, which are not specifically mentioned in this point.

The 14-day right of return does not apply to legal persons.
– The 14-day right of return does not apply to products ordered where the delivery time is more than 14 calendar days.

All disputes arising in connection with the fulfilment of the provisions of the general terms and conditions and the terms and conditions of the order shall be resolved by negotiation between the parties. If the parties fail to reach an agreement, the disputes arising shall be settled in accordance with the laws of the Republic of Estonia. In order to settle disputes, the consumer-customer also has the right to address the Consumer Disputes Committee, the information on which can be found HERE, or the European Union Consumer Dispute Resolution Platform, which can be found HERE, in order to defend his/her rights.
